Definitions
>a. "Buyer" means the person who buys or agrees to buy the goods from the seller.
b. "Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the seller.
c. "Delivery Date" means the date specified by the seller when the goods are to be delivered.
d. "Goods" means the articles that the buyer agrees to buy from the seller.
e. "Price" means the price for the goods which shall unless otherwise stated include carriage, packing and VAT.
f. "Seller" means BBBilliards Limited a company registered in England and Wales with company number 05417015, whose office is at Unit 8, SBI Centre, Memorial Road, Hanham, Bristol. BS15 3JE.
1. Condition Applicable
1.1. These conditions shall apply to all contracts for the sale of the goods and shall prevail over any terms provided by the purchaser unless otherwise agreed in writing. When Placing an order with us you confirm that you have read our Terms and Conditions and are agreeing to accept our Terms and Conditions.
1.2. Sellers right to cancel
The seller may cancel this contract at any time before the goods are delivered by giving written notification (via e-mail or post). On giving such notice the seller shall promptly repay to the buyer sums paid in respect of the price. The seller shall not be liable for any loss or damage whatsoever arising from such cancellation.
1.3. Buyers right to cancel
The buyer may cancel this contract at any time before the goods are delivered by giving written notice to the seller: If notice of cancellation is given more than 48 hours before the due date of delivery, the buyer shall be liable to the seller for 25% of the price of the goods. If notice of cancellation is given after the goods have been shipped for delivery, the buyer shall be liable to the seller for the full price of the goods, together with any costs or damages of the seller arising from such cancellation.
2. Prices
2.1. Due to unsettled market conditions, orders are only accepted on the basis that goods will be charged at the prices ruling at the time of despatch.
2.2. Any special request by the buyer for goods to be delivered by any means other than the sellers normal FREE delivery service (eg. advanced delivery) shall be subject to an additional charge to cover the extra cost to the seller.
2.3. Quotations and Acceptance, a quotation by the seller does not constitute an offer and the seller reserves the right to withdraw or revise a quotation at any time prior to the acceptance or the buyers order.
2.4. No contract may be cancelled or altered by the buyer accept with the prior consent of the seller.
2.5. The price is inclusive of VAT which is at the rate ruling on the date of the sellers invoice.
3. V.A.T.
3.1. All published prices are inclusive of Value Added Tax, which is included in the price of all packaging and delivery where applicable.
4. Delivery - Pickup on any eBay item is not an option.
4.1. Delivery costs of all goods sold on eBay are as shown in the Postage Costs field of the listing. Delivery costs listed are for UK Mainland deliveries only, excluding some large and heavy items which are restricted to within a stated distance of Bristol, this distance being stated in the item description but no more than 200miles from Bristol. Deliveries out side mainland UK and for heavy items out side there stated distance will require a custom delivery cost and buyers are requested to contact us on 01179831450 for a quote before purchasing any items.
4.2. Any special request by the buyer for goods to be delivered by any means other than the sellers normal FREE delivery service (eg. advanced delivery) shall be subject to an additional charge to cover the extra cost to the seller.
4.3. The buyer shall ensure that all arrangements necessary to take delivery of the goods whenever and wherever they are tendered for delivery are made. Unless otherwise determined by the seller all deliveries will be carried out by a 1 person delivery, so that the buyer is required to procure that all necessary assistance is provided to the delivery driver in the removal and carrying of the goods from the vehicle to the buyers requested point of delivery.
4.4. Please allow up to 14 days for delivery from date of payment. Delivery times are approximate and do not constitute part of any contract. Delivery/despatch dates are given in good faith but we cannot be held responsible or liable for an loss or damages caused to you the customer due to delayed delivery or despatch however caused.
4.5. If the buyer refuses or fails to take delivery of goods tendered in accordance with the contract or fails to take any action necessary on its part for delivery and or shipment of goods, the seller shall be entitled to terminate the contract with immediate effect and to recover from the buyer any loss and additional costs incurred as a result of such refusal or failure (including , without limitation, storage and insurance costs from the due date of delivery).
4.6. World Delivery, all charges are based on Destination, Total Consignment Weight and Volume of the package. All conditions 4.3, 4.4, and 4.5 as above apply. Delivery costs paid are simply to get the goods to a customers door. If the delivery country is outside the EU delivery costs will not cover Import Taxes and Duties if applicable. It is the responsibility of the customer to find out what the taxes and duties will be on there order if applicable and to pay the Taxes and Duties or assign an agent to manage the import of your order.
5. Damaged or loss of goods in transit liability
5.1. All goods are at buyers risk as soon as they have been delivered. Once goods have been dispatched our liability is limited to our carrying contractors terms and conditions.
5.2. The buyer shall procure that the goods are inspected immediately upon delivery being effected and shall procure that, in any event, the seller is notified in writing within 2 days of the date that delivery has been effected of any alleged defect, shortage in quantity, damage or failure to conform with the contract. The buyer shall procure that the seller is afforded an opportunity to inspect the goods (via e-mail photographic evidence or return of goods to BBBilliards Ltd) within a reasonable time and before any use is made of the goods, for the purposes of verifying any such alleged defect, shortage in quantity, damage, or non-conformity with the contract. If the buyer shall fail to comply with these provisions, the goods shall be conclusively presumed to be in accordance with the contract and free from any defect or damage which would be apparent on a reasonable examination of the goods, and the buyer shall be deemed to have accepted the goods. Any returns must conform to the returns policy outlined below in section 11.
5.2.1. In the event that the buyer proves to the seller's absolute satisfaction that the goods that have been delivered are damaged, defective or otherwise fail to conform to the contract and PROVIDED THAT the buyer has complied fully with its obligations under condition 5.2 the buyer shall be entitled to be refunded the cost of such goods.
5.2.2. In the event that the buyer proves to the seller's absolute satisfaction that the goods that have been delivered are damaged, defective or otherwise fail to conform to the contract BUT the buyer has failed to comply fully with its obligations under condition 5.2 the buyer shall not be entitled to be refunded the costs of such goods but instead the seller may, at its sole discretion, offer to replace such goods strictly on the basis that the buyer shall be responsible for all costs incurred in returning the relevant goods and delivering the replacement goods.
5.2.3. In the event of any missing or damaged components at the time of delivery, the seller reserves the right to supply replacement components at it's own cost.
5.3. The sellers aggregate liability to the buyer whether for negligence, breach of contract misrepresentation or otherwise shall in no circumstances exceed the costs of the defective, damaged or undelivered goods which give rise to such liability, as determined by the price invoiced to the buyer in respect of any occurrence or series of occupancies.
5.4. The seller shall be under no liability to the buyer for any loss damage, costs, expenses, claims, actions, proceeding or injury, direct or indirect, resulting from defects in design, materials or workmanship or otherwise howsoever arising including, without limitation, those which arise out of or in connection with the delivery of any goods to the buyer (and weather or not caused by the negligence of the sellers its employees or agents).
5.5. Non delivery of goods must be advised within 14 working days of despatch.
6. Ownership of goods
6.1. All goods remain the property of B.B.Billiards Limited until payment has been made.
7. Description of goods
7.1. The seller warrants that the goods will at the time of delivery correspond to the description given by the seller, however all specifications of goods are approximate and may vary slightly from the published details. B.B.Billiards Limited reserves the right to substitute goods subject to variation and modification without notice providing the goods do not differ materially.
8. Defective Goods
8.1. Defective goods will be replaced at all times, a refund will be offered if the item is out of stock. No merchandise will be accepted for replacement or credit without prior authorisation.
9. Cancellation
9.1. Once a contract exists between B.B.Billiards Limited and the purchaser that contract may not be cancelled by the purchaser except with B.B.Billiards Limited consent and on terms that will indemnify B.B.Billiards Limited against all loss.
10. Payment
10.1. Payment is due in advance of
delivery.
Method of payment is by Credit/Debit
card, PayPal balance, direct bank payments through paypal, discover payment through paypal or by a cheque supported by a bankers card. Cheque's without
a bankers card no. must be cleared prior to despatch of goods.

10.3. Any invoice discrepancies must be advised in writing or via e-mail by the buyer to the seller within 14 days from date of invoice.
11. Returns
11.1. In order that the buyer may return goods for what ever reason the buyer must contact customer services on 01179831450 for a returns authorisation number. All products being returned (for what ever reason) must be complete and in their original UN-USED condition including all packaging, instructions and accessories. BBBilliards Limited reserve the right to levy a handling charge. A charge of 20% of the invoice value, with minimum charge £10 will be levied on goods 'not wanted' or 'incorrectly ordered'. We must receive all goods returned under this provision within 14 days of original invoice date.
11.2 BBBilliards Ltd reserve the right to levy a charge up to the value of the goods being returned or to refuse a return if the goods are sent back USED.
11.3 In the event that an item is being returned by the buyer not via our couriers the buyer is required to acquire proof of posting. In the event that the package does not reach us the buyer can then provide this proof of posting to enable BBBilliards Limited to furnish the buyer with a replacement or refund.
12. Force Majeure
12.1. The seller shall not be liable to the buyer for any loss or damage which may be suffered by the buyer as a direct or indirect result of the supply of goods by the seller being prevented, hindered, delayed, cancelled or rendered uneconomic by reason of circumstances or events beyond the sellers reasonable control ("Force Majeure circumstances") including, but not limited to, strikes, lockouts, labour disputes, acts of god, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm, difficulty or increased express in obtaining workers, materials, or transport or other circumstances effecting the supply of the goods or raw materials by the sellers normal source of supply or the manufacture of the goods by the sellers normal means or the delivery of the goods by the sellers normal route or means of delivery.
12.2. In Force Majeure circumstances the seller may in its sole discretion terminate any contract for the supply of goods pursuant to these conditions or cancel delivery of goods to the buyer or may, with the agreement of the buyer, deliver goods at an agreed rate of delivery commencing after any suspension of deliveries.
12.3. If due to Force Majeure circumstances the seller has insufficient stocks to meet all it's commitments the seller may apportion available stocks between its customers at it's sole discretion.
13 PRIVACY:
13.1. BBBilliards Limited is committed to protecting customer privacy and all information is used lawfully and in accordance with the Data Protection Act 1998. We will not pass any details on to any third party. We do NOT store any customer card details. All card payment details are handled for us by a third party secure server which complies with the industry standard PCI DSS standards of security put in place by Visa and Mastercard.
Any personally identifying information divulged to BBBilliards Limited via our website will be processed on our secure servers.
Pages on our website that request personal information are protected using SSL (Secure Socket Layer) security, which encrypts any data transmitted - please see our security policy for full details. This level of encryption is the same level of security used by some of the biggest banks in the world online.
