Right to Title
There are a number of things you must ascertain when purchasing property abroad.
- What exactly you are buying
- Whether you are buying from the genuine owners
- What (if any) restrictions or burdens are on the property
- How the formal title has been acquired / Will this lead to future problems?
It is very important to have an independent lawyer check all documents and the agreement before you part with a penny. This will avoid any loss of deposit if the title is not up to standard. You should always walk away from the deal if you are not 100% satisfied with title search. Your lawyer should negotiate terms that suit you not the seller, and steer you away from properties if there are any potential problems. Emerge (UK) Ltd recommends every client conducts title search and investigation before any agreement is signed. No completion should be executed before title study produces satisfactory results.
There are many pitfalls you can avoid by having all documention checked by a solicitor. For example, in Bulgaria, it is not unusual for all family members to have equal ownership rights of the property. This means that unless they all agree to the sale they still have a legal claim to your house. So picture this - you buy a property for £5,000 and spend £5,000 on renovation. The house is now worth £20,000! Great...time to open a bottle of Rakia and celebrate.
Or is it? Not if you later find out that two people previously owned the house but only one signed the contract. Legally in Bulgaria, the person who did not sign over title rights would have a 50% claim to your property. This is so easy to avoid if you have the documents checked by a lawyer before buying!
Top tip. If a seller states that you do not need to take expert advice ask yourself why? The best thing you can do is walk away !
My story
Let me introduce myself. My name is Paul and I would like to tell you how my business Emerge (UK) ltd was formed. I hope it gives you an idea of how this company will treat you as a client and the reason why.
I travelled to Bulgaria for a holiday in 2006 and liked it so much I decided to purchase a property there. The same as you I had doubts about buying property abroad and had heard stories of English people losing money to so called developers. I decided to find out as much about the process involved when buying property abroad as I could. Having graduated in law I more than understood the importance of seeking the advice of a lawyer specializing in property law.
To be honest the experience I had was a nightmare. All the developers I spoke to asked me to pay a deposit there and then and didn't want me to seek advice from property experts. I already knew that debt passed with the property not the person....I could have ended up buying a house with 1000s of pounds of debt registered to it that I was legally liable to pay! I also discovered that the agents were putting a huge commission on each sale for themselves and paying the true owners a small percentage of the profit. The people from the villages were poor and selling the one asset they had for a fraction of its true value. The only people who appeared to be making any real money from the sale were the middleman, who were raking in 1000s of pounds from villagers who did not understand Bulgarian property law and the process involved. The village owners were kind people but had no idea about the true value of the property they were selling. The houses had often been passed from one family member to another for generations.
On my return to the UK it was time to collect my thoughts and decide on my next step. Having seen how some developers conducted business I knew I could better. There was only one thing for it - two weeks later I returned to Bulgaria and Emerge (UK) ltd was formed and registered in the court of Rousse.
Since then people from all over the world have visited Bulgaria and viewed property with us. Our way of conducting business is to let clients make their own mind up about the buying decision. If a client does purchase a property from Emerge it will be because of a choice they make themselves, not because of a salesman on commission making a hard sell. It is always recommended that clients return to the UK to discuss their trip with family and friends before committing. This allows time to decide if buying property abroad really is the right choice to make. If so, the whole process can then be undertaken by giving POA to a lawyer.
This is how the underlying principles of my company were formed, and these values are at the core of how Emerge conducts its business.
