Preliminary remark

Between the customer and the respective performance supplier, VIRTUALGAMEWORLDS Ltd. solely acts as a mediator. The contract of the “available making” of the game assistance is contracted by the customer directly with the performance supplier. For the legal relationship between the customer and the performance supplier the legal terms and conditions of the ordered performance supplier, which can be provided on demand, are effective.  

§ 1 General

1.1 For these offers the following legal terms and conditions are effective. These legal terms and conditions can be requested at VIRTUALGAMEWORLDS Ltd. via email or written on demand. They are effective for every order at VIRTUALGAMEWORLDS Ltd. 

1.2 Legal terms and conditions to the contrary of the orderer are not approved by VIRTUALGAMEWORLDS Ltd. This is valid as well, if VIRTUALGAMEWORLDS Ltd. has not contradicted them in particular cases. 

1.3 By establishing of the business connection with VIRTUALGAMEWORLDS Ltd. the orderer approves in each case the latest version of the legal terms and conditions for all legal relationships between him and VIRTUALGAMEWORLDS Ltd.

1.4 A commercial use of the performances of VIRTUALGAMEWORLDS Ltd. and/ or its websites is illegal. 


§ 2 Subject matter of the contract and conclusion of the contract 

2.1 Between the customer and VIRTUALGAMEWORLDS Ltd. an in return for payment service agreement is contracted based on which VIRTUALGAMEWORLDS Ltd. bounds itself, to mediate the customer the contractual partner (the following service provider) who is able provide the wanted game assistance (item, gold, character etc.) as fast as possible at the stipulated price. VIRTUALGAMEWORLDS Ltd. mediates every relevant terms and conditions with the service provider. This includes goods, kind, price, offer and acceptance of the contract, provision of the services respectively the goods. VIRTUALGAMEWORLDS Ltd. only works with reliable and trustworthy performance suppliers. 

2.2 Between the customer and the respective performance supplier, VIRTUALGAMEWORLDS Ltd. solely acts as a mediator. The contract of the “available making” of the game assistance is contracted by the customer directly with the performance supplier. For the legal relationship between the customer and the performance supplier the legal terms and conditions of the ordered performance supplier, which can be provided on demand, are effective.  

2.3 The customer is liable for the payment of the respective reward to VIRTUALGAMEWORLDS Ltd. It takes over the for the customer toll-free forwarding of the, the performance supplier owing, reward. 

2.4 The customer has to ensure, that on his side, the technical and the realities for the receiving of the game assistances are fulfilled. It is also the case of the customers to keep appropriate software ready, which enables an adequate opening, editing and using of the game assistances. Are these requirements not met is this without influence on the establishing of the contract between the customer and VIRTUALGAMEWORLDS Ltd. 



§3 Order, conclusion of the contract

3.1. The offers of VIRTUALGAMEWORLDS Ltd. are not legally bound offers, but a noncommittal request to submit such a bound offer to enter into a mediation contract.  

3.2. The customer gives, by submitting his order, a committal bid on entering a mediation contract, which becomes valid, if VIRTUALGAMEWORLDS Ltd. accepts it. 

3.3. Due to the order of the customer and the concerning acceptation by VIRTUALGAMEWORLDS Ltd., as the case maybe by the particular performance supplier, there can be accomplished two contracts:

- a mediation contract with VIRTUALGAMEWORLDS Ltd. 

- the mediated contract with the performance supplier 

The contract of the mediation of performances is accomplished by the following, the bid of the customer happens as described at 3.1 and 3.2. The mediated contract with the performance supplier is accomplished by sending or fulfilling of the service. The mediation contract with VIRTUALGAMEWORLDS Ltd. is accomplished either by individual verification (e.g. email) or at the latest by sending or fulfilling of the service.

3.4. The performance supplier is informed by VIRTUALGAMEWORLDS Ltd. about the customers bid. 
He takes the wanted service in corresponding amounts irreparable out of the system.
By this booking the contract between the performance supplier and the customer is accomplished. The performance supplier manifests his acceptance to the customer by sending  the ordered game assistance.       


§4 Delivery  

4.1. The devolvement of the objects of agreement is done by the performance supplier depending on the related game, for which the particular assistance is needed for.  

4.2. For details see the general terms and conditions of the performance supplier.

4.3. From the time of delivering of the ordered goods the customer gains the responsibility. 
For loss or damage from this point in time VIRTUALGAMEWORLDS Ltd. is no longer liable.


§5 Prices and payment 

5.1. All indicated prices are final prices. Eventual costs for eventual package and forwarding are not included. 

5.2 Due to the permanent updating of the internet page of VIRTUALGAMEWORLDS Ltd. previously made indications, concerning the prices, lose their validation. The shown price at the time of placing the bid from the customer is decisive for the bill of cost.   

5.3 The payment can be done by credit card (Paypal, Visa or Mastercard), Moneybookers, Sofortueberweisung or per bank transfer. For all electronic Payments we reserve the right to ask for additional proof before we accept payments. i.e phonecheck, ID Card, Driver license and so on

§6 Communication with the customer 

6.1. The communication between VIRTUALGAMEWORLDS Ltd. and the customer is mainly done by e-mail or live support chat. 

6.2. The customer is responsible to be reachable via e-mail or any other with VIRTUALGAMEWORLDS Ltd. stipulated communication way. The customer has especially to make sure, that e-mails from VIRTUALGAMEWORLDS Ltd. can actually reach him. This also includes safety settings, e.g. spam filter and to check an eventual folder for spam.  

§7 Right of rescission, right to return

7.1. You can give the received goods, without giving reasons, within 2 weeks, by retransfer of the object of contract, back. This period begins earliest by receiving the goods and the receiving of this instruction. You can explain the return also by the demand of withdrawal in text form, as e.g. letter, fax or e-mail. To keep the period it is enough to forward the goods or the demand of withdrawal in time. The demand of withdrawal has to be sent to the following address:

7.2. VIRTUALGAMEWORLDS Ltd. mediates solely the rescission of the contract between the performance supplier and the customer. 

7.3. The mediation contract between VIRTUALGAMEWORLDS Ltd. and the customer expires with the in time exercise of the right of return against the performance supplier. 

7.4. In case of a demand of withdrawal the on both sides received benefits have to be awarded back and should the situation arise the gained advantage as well. If you are not able to return the received goods complete or in a changed form you have to give us insofar compensation.
This does not apply, if the change only happened to check the object of contract. Apart from that you cannot avoid the compensation, while you do not take the object of contract into use like an owner and avoid any change of the object of contract within the revocation period. 

7.5. Should the orderer cancel his order after 14 days and VIRTUALGAMEWORLDS Ltd. refunds his money, so the orderer has to face a processing fee of 15% / min 10€. 




§8 Necessity of a game account, terms of use of the online games

VIRTUALGAMEWORLDS Ltd. explicitly calls the attention that some provider of online games try to prevent the performances of VIRTUALGAMEWORLDS Ltd. and its performance completion. VIRTUALGAMEWORLDS Ltd. is not liable, if a provider of online games takes action against the orderer. VIRTUALGAMEWORLDS Ltd. is especially not liable for an eventual blocking of an account of the orderer by a provider of the online game due to the use of the offerings of VIRTUALGAMEWORLDS Ltd. 
   
§9 Liability 

9.1. Should the provider of the online game impose sanctions (e.g. blocking of the account or the character) due to the previous transaction against the orderer, VIRTUALGAMEWORLDS Ltd. will pay the previously paid money back to the orderer. Additional demands of the orderer do not exist in this case. The demand according clause 1 paragraph 1 requires, that the orderer presents VIRTUALGAMEWORLDS Ltd. a written message of the provider of the online game about the sanction. The electronic form is not enough, the written form is needed. 

9.2. VIRTUALGAMEWORLDS Ltd. does not offer online games and is due to that not liable for damages which result of that the affected online game is not reachable or access able. This especially does apply if the affected online game is not reachable or access able temporarily or permanent for all players or certain player groups. The disclaimer of clause 1 of this paragraph 2 also applies for cases, in which the affected online game is not reachable or access able for individual players. 

9.3. VIRTUALGAMEWORLDS Ltd. is anxious to accomplish every given order without slowdown or delay.  
In occurrence of technical problems or reasons which fall out of its power of control, VIRTUALGAMEWORLDS Ltd. will be anxious to accomplish the order as fast as possible.  

9.4. VIRTUALGAMEWORLDS Ltd. is not liable for eventual damages which are caused by mistakes of the data processing, system- or submission problems or other problems that are not caused by VIRTUALGAMEWORLDS Ltd. or its performing agents or other troubles that make it impossible to accomplish the order which are not caused by VIRTUALGAMEWORLDS Ltd. or its performing agents. 

9.5. There is no warrant for the availability and the functionality of the websites of 
VIRTUALGAMEWORLDS Ltd.  

9.6. The orderer cannot claim anything else beyond the mentioned terms, no claims for compensation, especially no compensation for damages, also not from non-contractual claims or any other rights due to eventual disadvantages that are related to the contract performance, against VIRTUALGAMEWORLDS Ltd., regardless on which legal ground those claims are based on. This is especially essential for compensation for damages from fault at the conclusion of the contract, due to other breaches of duty or because of tort claims. 

9.7. The above mentioned disclaimer does not apply for the liability for damage to life, body or health. It is furthermore not true, as far as the damage is based on purpose or gross negligence or the damage of a cardinal- or primary contractual obligation.

9.8. The liability to pay damages at a violation of cardinal- or primary contractual obligations is limited to the predictable damage. 

9.9. For claims with pure financial losses the liability to the orderer, in cases of slight negligence, is limited to the already paid fee of the particular order to VIRTUALGAMEWORLDS Ltd., as far as an above mentioned restriction of liability is not provided. 

9.10. Above mentioned restrictions of liability respectively limitations apply also concerning the liability of the employees, associates, representatives and the vicarious agents of VIRTUALGAMEWORLDS Ltd. 

§10 Copyrights and related rights 

10.1 The web pages of VIRTUALGAMEWORLDS Ltd. are copyright protected. 

10.2. The pages must only be used by the purpose VIRTUALGAMEWORLDS Ltd. provides. Especially the database must only be called with a web browser trough www.Virtualgameworlds.com. The in there contained information must not be duplicated. All shown external logos, pictures and graphics are owned by the respective firms and are subject to the copyrights of the respective licenser.   
All on the pages of VIRTUALGAMEWORLDS Ltd. shown photos, pictures, logos, texts, reports, scripts and the source code, which are proprietary developments or have been rehashed by VIRTUALGAMEWORLDS Ltd., must not be copied or used in other ways without its permission.

10.3. Every not in No.2 of this §10 explicitly authorized usage has to be authorized by VIRTUALGAMEWORLDS Ltd. formally towards the respective orderer. 

§11 Data privacy 

The transferred information of the orderer is solely used by VIRTUALGAMEWORLDS Ltd. to process the order. All information is used in strict confidence. A passing on to a third party (e.g. performance supplier) only takes place as far as it is necessary for the processing of the contract. The order information is processed encrypted and secured. VIRTUALGAMEWORLDS Ltd. does not take liability for the data security during the submitting through the internet (e.g. due to technical problems of the provider) or for an access of a third party to data of your internet presence. Access data, which is sent on demand from the orderer to the orderer, has to be handled in strict confidence, because VIRTUALGAMEWORLDS Ltd. does not take any responsibility for the utilisation and usage for this data. 


§12 Links on the web pages of VIRTUALGAMEWORLDS Ltd. 

Despite careful content control we do not take liability for the content of external links. For the content of the linked pages are solely their operators liable.

§13 Jurisdiction

§14 Legal force of the general terms and conditions 

14.1 With an order the general terms and conditions of VIRTUALGAMEWORLDS Ltd. are accepted. Should one of these regulations, whatever the reason maybe, be invalid, the other regulations stay unaffected. 

14.2 Oral agreements require the written affirmation.

Zwischen dem Kunden und dem jeweiligen Leistungsträger ist Virtualgameworlds LTD ausschließlich als Vermittler tätig. Den Vertrag des „zur Verfügung stellen?der Spielhilfen schließt der Kunde direkt mit dem Leistungsträger.
Für das Rechtsverhältnis zwischen dem Kunden und dem Leistungsträger gelten die Allgemeinen Geschäftsbedingungen des beauftragten Leistungsträgers, die auf Wunsch zur Verfügung gestellt werden.

§ 1 Allgemeines

1.1. Für diese Angebote gelten die nachfolgenden AGB. Diese AGB können auf Wunsch auch bei Virtualgameworlds LTD per E-Mail oder schriftlich angefordert werden. Sie gelten für alle Bestellungen bei Virtualgameworlds LTD.
1. 2. Entgegenstehende Geschäftsbedingungen des Bestellers werden von Virtualgameworlds LTD nicht anerkannt. Dies gilt auch dann, wenn Virtualgameworlds LTD diesen im Einzelfall nicht widersprochen hat.
1. 3. Durch Aufnahme der Geschäftsverbindung mit Virtualgameworlds LTD erkennt der Besteller die jeweils aktuelle Version dieser AGB für alle Rechtsverhältnisse zwischen ihm und der Virtualgameworlds LTD an.
1. 4. Eine kommerzielle Nutzung der Leistungen der Virtualgameworlds LTD und / oder ihrer Websites ist unzulässig.

§ 2 Vertragsgegenstand und Vertragsschluss

2.1. Zwischen dem Kunden und der Virtualgameworlds LTD wird ein entgeltlicher Vermittlungsvertrag geschlossen aufgrund dessen sich die Virtualgameworlds LTD verpflichtet, dem Kunden denjenigen Vertragspartner (im folgenden Leistungsträger) zu vermitteln, der ihm die gewünschte Spielhilfe (Item. Gold, Spielfigur, Account Key, Game Time, Abonnements etc.)  schnellstens zum vereinbarten Preis zur Verfügung stellen kann. Virtualgameworlds LTD verhandelt alle relevanten Bedingungen und Konditionen mit dem Leistungsträger. Darunter fallen Ware, Beschaffenheit, Preis, Angebot und Annahme des Vertrages, Zurverfügungstellung des Services bzw. der Ware. Die Virtualgameworlds LTD arbeitet nur mit zuverlässigen und vertrauenswürdigen Leistungsträgern zusammen.
2.2. Zwischen dem Kunden und dem jeweiligen Leistungsträger ist Virtualgameworlds LTD ausschließlich als Vermittler tätig. Den Vertrag des „zur Verfügung stellen?der Spielhilfen schließt der Kunde direkt mit dem Leistungsträger.
Für das Rechtsverhältnis zwischen dem Kunden und dem Leistungsträger gelten die Allgemeinen Geschäftsbedingungen des beauftragten Leistungsträgers, die auf Wunsch zur Verfügung gestellt werden.
2.3. Der Kunde ist zur Zahlung des entsprechenden Entgelts an die Virtualgameworlds LTD verpflichtet. Diese übernimmt die für den Kunden gebührenfreie Weiterleitung des dem Leistungsträger zustehenden Entgelts.
2.4. Der Kunde hat sicherzustellen, dass auf seiner Seite die technischen und tatsächlichen Voraussetzungen für den Empfang der Spielhilfen gegeben sind. Ebenso ist es Sache des Kunden, geeignete Software bereitzuhalten, die ein ordnungsgemäßes Öffnen, Bearbeiten und Verwenden der Spielhilfen ermöglicht. Sind diese Voraussetzungen nicht erfüllt ist dies ohne Einfluss auf das Zustandekommen des Vertrages zwischen dem Kunden und der Virtualgameworlds LTD.

§ 3 Bestellung, Vertragsschluss.

3.1. Das Angebot der Virtualgameworlds LTD ist kein rechtlich bindendes Angebot, sondern eine unverbindliche Aufforderung ein solch bindendes Angebot zum Abschluss eines Vermittlungsvertrags abzugeben.
3.2. Der Kunde gibt durch die Absendung seiner Bestellung ein verbindliches Angebot auf Abschluss eines Vermittlungsvertrages ab, welcher zustande kommt, wenn die Virtualgameworlds LTD dieses annimmt.
3.3. Durch die Bestellung des Kunden und die entsprechende Annahme durch die Virtualgameworlds LTD bzw. durch die jeweiligen Leistungsträger kommen zwei Verträge zustande kommen:
- ein Vermittlungsvertrag mit der Virtualgameworlds LTD
- der vermittelte Vertrag mit dem Leistungsträger
Der Vertrag zur Vermittlung von Leistungen kommt wie folgt zu Stande, das Angebot des Kunden erfolgt wie unter 3.1. und 3.2. beschrieben. Der vermittelte Vertrag mit dem Leistungsträger kommt durch Zusendung oder Erfüllung der Dienstleistung zu Stande. Der Vermittlungsvertrag mit der Virtualgameworlds LTD kommt Zustande entweder durch individuelle Bestätigung (z.B email) oder spätestens mit Zusendung oder Erfüllung der Dienstleistung.
3.4. Der Leistungsträger wird von Virtualgameworlds über das Angebot des Kunden informiert und nimmt diese gewünschte Dienstleistung durch Buchung aus dem System. Mit dieser Buchung ist der Vertrag zwischen dem Kunden und dem Leistungsträger zustande gekommen. Der Leistungsträger erklärt die Annahme gegenüber dem Kunden durch die Zusendung der bestellten Spielhilfen.

§ 4 Lieferung

4.1. Die Übertragung der Vertragsgegenstände erfolgt durch den Leistungsträger in Abhängigkeit von dem zugehörigen Spiel, für das die jeweilige Hilfe benötigt wird.
4.2. Für Einzelheiten wird auf die AGB´s der Leistungsträger verwiesen.

§ 5 Preise und Zahlung

5.1. Alle angegebenen Preise sind Endpreise. Eventuelle Kosten für eventuelle Verpackung und Versand sind nicht enthalten.
5.2. Durch die ständige Aktualisierung der Internetseite der Virtualgameworlds LTD verlieren zu einem früheren Zeitpunkt gemachte Angaben bezüglich der Preise Ihre Gültigkeit. Der ausgewiesene Preis zum Zeitpunkt der Abgabe des Angebotes des Kunden ist für die Abrechnung maßgeblich.
5.3. Die Zahlung kann per Paypal oder per Überweisung u.a.erfolgen. Aufgrund der vielen Betrugsversuche im Zusammenhang mit gehackten Paypalkonten werden alle Kunden die Paypal als Zahlungsmittel wählen bei der ersten Zahlung geprüft, dazu bedient sich virtualgameworlds verschiedener Methoden.
5.4.SOWEIT NICHT ANDERS BESCHRIEBEN SIND ALLE ZAHLUNGEN INNERHALB 7 TAGEN ZU LEISTEN. VERSPÄTETE ZAHLUNG WERDEN ERSTATTET.

§ 6 Kommunikation mit dem Besteller

6.1. Die Kommunikation zwischen Virtualgameworlds LTD und dem Besteller erfolgt in erster Linie per E-Mail.
6.2. Der Besteller ist dafür verantwortlich, per E-Mail und zusätzlich auf sonstige mit Virtualgameworlds LTD als Kommunikationskanal vereinbarte Weise erreichbar zu sein. Der Besteller muss insbesondere dafür sorgen, dass ihn E-Mails von Virtualgameworlds LTD tatsächlich erreichen. Hierzu zählen auch Sicherheitseinstellung, beispielsweise der Spam-Filter, und die Prüfung eines etwaigen Ordners für Spam.

§ 7 Widerrufs- und Rückgaberecht

7.1 Sie können die erhaltene Ware ohne Angabe von Gründen innerhalb von 1 Monat durch Rücksendung des Vertragsgegenstands zurückgeben. Die Frist beginnt frühestens mit Erhalt der Ware und dem Erhalt dieser Belehrung. Sie können die Rückgabe auch durch Rücknahmeverlangen in Textform, also z.B. Brief, Fax oder E-Mail erklären. Zur Wahrung der Frist genügt die rechtzeitige Absendung der Ware oder des Rücknahmeverlangens. Das Rücknahmeverlangen ist an folgende Anschrift zu übermitteln:

7.2 Die Virtualgameworlds LTD vermittelt ausschließlich die Rückabwicklung des Vertrages zwischen Leistungsträger und Kunde.
7.3 Der Vermittlungsvertrag zwischen Virtualgameworlds LTD und dem Kunden erlischt mit rechtzeitiger Ausübung des Rückgaberechts gegenüber dem Leistungsträger.
7.4 Im Falle eines Rücknahmeverlangens sind die beiderseits empfangenen Leistungen zurück zu gewähren und gegebenenfalls gezogene Nutzungen herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verändertem Zustand zurück gewähren, müssen Sie uns insoweit Wertersatz leisten. Dies gilt nicht, wenn die Veränderung nur erfolgte, um die Prüfung des Vertragsgegenstands vorzunehmen. Im Übrigen können Sie die Wertersatzpflicht vermeiden, indem Sie den Vertragsgegenstand nicht wie ein Eigentümer in Gebrauch nehmen und innerhalb des Laufs der Widerrufsfrist jede Veränderung des Vertragsgegenstands unterlassen.

§ 8 Notwendigkeit eines Spiel Accounts; Nutzungsbedingungen der Online-Spiele.

Virtualgameworlds LTD macht ausdrücklich darauf aufmerksam, dass manche Anbieter von Online-Spielen versuchen, die Leistungen von Virtualgameworlds LTD und deren Leistungserbringern zu unterbinden. Virtualgameworlds LTD haftet nicht, falls ein Anbieter von Online-Spielen Maßnahmen gegen den Besteller ergreift. Virtualgameworlds LTD haftet insbesondere nicht für eine etwaige Sperrung des Accounts des Bestellers durch den Anbieter des Online-Spiels aufgrund der Nutzung von der Angebote von Virtualgameworlds LTD.

§ 9 Haftung

9.1. Sollte der Anbieter des Online-Spiels gegen den Besteller aufgrund der vorstehenden Transaktion Sanktionen verhängen (beispielsweise Sperrung des Accounts oder des Charakters), wird Virtualgameworlds LTD dem Besteller das Entgelt für die Vermittlung erstatten. Weitere Ansprüche des Bestellers bestehen in diesem Fall nicht. Der Anspruch nach Satz 1 dieses Absatzes 1 setzt voraus, dass der Besteller der Virtualgameworlds LTD eine schriftliche Mitteilung des Anbieters des Online-Spiels über die Sanktion vorlegt. Die elektronische Form genügt nicht der Schriftform.
9.2. Virtualgameworlds LTD bietet keine Online-Spiele an und haftet daher nicht für Schäden, die daraus entstehen, dass das betroffene Online-Spiel nicht erreichbar oder zugänglich ist. Dies gilt insbesondere für Fälle, in denen das betroffene Online-Spiel zeitweilig oder dauerhaft für alle Spieler oder bestimmte Spielergruppen nicht erreichbar oder zugänglich ist. Der Haftungsausschluss nach Satz 1 dieses Absatzes 2 gilt aber auch für Fälle, in denen das betreffende Online-Spiel nur für einzelne Spieler nicht erreichbar oder zugänglich ist.
9.3. Virtualgameworlds LTD ist bemüht, alle erteilten Aufträge ohne Verzögerung oder Verspätung auszuführen. Bei Auftreten von technischen Problemen oder Ursachen, die außerhalb ihrer Verfügungsgewalt liegen, wird die Virtualgameworlds LTD sich bemühen, den Auftrag baldmöglichst auszuführen.
9.4. Virtualgameworlds LTD haftet nicht für eventuelle Schäden, die dadurch entstehen, dass es ihr aufgrund von ihr nicht zu vertretender Fehler der Datenverarbeitung, System- oder Übertragungsstörungen oder anderen nicht von ihr oder ihren Erfüllungsgehilfen zu vertretenden Störungen unmöglich ist, den Auftrag auszuführen.
9.5. Für die Verfügbarkeit und Funktionsfähigkeit der Webseiten der Virtualgameworlds LTD wird keine Gewähr übernommen.
9. 6. Der Besteller kann über die ihm in diesen Bedingungen zugestandenen Ansprüche hinaus keine Ersatzansprüche, insbesondere keine Ansprüche auf Schadensersatz, auch nicht aus außervertraglicher Haftung (ausgenommen der Ansprüche nach §§ 1, 4 Produkthaftungsgesetz), oder sonstige Rechte wegen etwaiger Nachteile, die mit der Vertragsleistung zusammenhängen, gegen Virtualgameworlds LTD geltend machen, gleichgültig auf welchem Rechtsgrund solche Ansprüche beruhen. Dies gilt insbesondere für Schadenersatzansprüche aus Verschulden bei Vertragsabschluss, wegen sonstiger Pflichtverletzungen oder wegen deliktischer Ansprüche gem. § 823 BGB.
9. 7. Vorstehender Haftungsausschluss gilt jedoch nicht für die Haftung bei Verletzung von Leben, Körper und Gesundheit. Er gilt ferner nicht, soweit der Schaden auf Vorsatz oder grober Fahrlässigkeit oder der Verletzung einer Kardinal- oder wesentlichen Vertragspflicht beruht.
9. 8. Die Ersatzpflicht ist bei der Verletzung von Kardinal- oder wesentlichen Vertragspflichten jeweils auf den vorhersehbaren Schaden beschränkt.
9. 9. Für Schadensfälle mit reinen Vermögensschäden ist die Haftung gegenüber dem Besteller in Fällen einfacher Fahrlässigkeit auf das für die für die jeweilige Bestellung an Virtualgameworlds LTD bezahlte Entgelt beschränkt, sofern nicht vorstehend eine weitergehende Haftungseinschränkung vorgesehen ist.
9. 10. Vorstehende Haftungsausschlüsse bzw. -beschränkungen gelten auch im Hinblick auf die Haftung der Angestellten, Arbeitnehmer, Mitarbeiter, Vertreter und Erfüllungsgehilfen von Virtualgameworlds LTD.

§ 10 Urheberrechte und ähnliche Rechte.

10.1. Die Internetseiten der Virtualgameworlds LTD sind urheberrechtlich geschützt.
10. 2. Die Seiten dürfen nur in der durch die Virtualgameworlds LTD vorgesehenen Weise genutzt werden. Insbesondere darf die Datenbank nur mit einem Webbrowser über die URL virtualgameworlds abgerufen werden. Die dort enthaltenen Informationen dürften nicht vervielfältigt werden. Alle dargestellten Fremdlogos, Bilder und Grafiken sind Eigentum der entsprechenden Firmen und unterliegen den Copyright er entsprechenden Lizenzgeber. § 11 Datenschutz

Die vom Besteller übermittelten Daten werden von Virtualgameworlds LTD ausschließlich zur Abwicklung der Bestellung verwendet. Alle Daten werden streng vertraulich behandelt. Eine Weitergabe an Dritte (z.B. Leistungsträger) erfolgt nur, sofern dies für die Vertragsabwicklung erforderlich ist. Die Bestelldaten werden verschlüsselt und gesichert übertragen. Die Virtualgameworlds LTD übernimmt jedoch keine Haftung für die Datensicherheit während der Übertragung über das Internet (z.B. wegen technischer Fehler des Providers) oder für einen Zugriff Dritter auf Dateien ihrer Internetpräsenz. Zugangsdaten, die auf Wunsch des Bestellers an diesen übermittelt werden, sind von ihm streng vertraulich zu behandeln, da die Virtualgameworlds LTD keinerlei Verantwortung für die Nutzung und Verwendung dieser Daten übernimmt.
