DELIVERY TERMS

Before Placing Your Order:

We advise you not to book kitchen fitters/installation engineers until the Products have arrived and been checked. We will not accept responsibility for any cancellation charges incurred by you for installation where Products have not arrived, or have been rejected by you.

We shall not be liable for any fault caused by incorrect installation or installation by non-qualified persons. We strongly recommend that a corgi-registered engineer install all Gas appliances.

Delivery Policy:

A. Arranging Delivery
We deliver Products to mainland UK postcodes as specified in our delivery costs section above.

Delivery will normally be by courier, by specialist carrier, or by specially contracted delivery service. Deliveries may take place from Monday to Friday between the hours of 7am and 7pm and will be confirmed by the relevant delivery company prior to delivery. Deliveries may be attempted outside of these hours during busy periods or due to circumstances beyond our control. Nextday & Saturday deliveries are only available by prior arrangement. Please call 0845 257 0348 to check availability.

Delivery will be made to the address specified in your order, unless you have advised us differently in advance. Please contact us if you wish delivery to be made to an address which is not the same as your billing address.

Major domestic appliances, including but not limited to Televisions above 32", Fridges, Cookers and Washing Machines, will be delivered to the room of your choice. As part of the pre-delivery survey, you will are asked to confirm that access is readily available. It is your responsibility to ensure the accuracy of the information you give regarding access. All other items are delivered to the door

B. Time of Delivery
For smaller Products delivery will normally be 2 - 5 working days; major domestic appliances are normally delivered within 3 - 10 days of acknowledgement of your order. We do our best to ensure delivery within 10 days of your order, but we cannot guarantee that delivery will be within this time frame. Any given dates for delivery are estimates only, and shall not be of the essence of the Contract.

Please note that next day deliveries are only available by prior arrangement. Please call 0845 257 0348 to check availability.


C. Changes to the Arranged Delivery
If you are unable to accept delivery on the agreed date you must notify us at least 48 hours before the planned day of delivery.

If you do not notify us within this time, or if the Products have already been dispatched, you will still be charged the delivery charge. If thereafter you fail to agree an alternative date within 2 weeks of the original delivery date, your order will be cancelled and you will be credited with the cost of the relevant Products, less any delivery and collection charges that we reasonably incur.

D. Action on Delivery
All Products must be carefully CHECKED against the delivery note and signed for by an adult of at least 18 years old. Any damage or shortages should be reported to us at the time of delivery by calling us on 0845 257 0348.

E. Problems With Delivery
Shortages

Any shortages noticed on delivery must be reported to the delivery person at the time of delivery, who will telephone us so that we may seek to resolve the problem to your satisfaction. You must clearly write on the delivery docket the number of parcels received and the number missing, and specify which Products are missing. If shortages are not noticed until after delivery has taken place, you must notify us as soon as is reasonably possible after becoming aware of the shortages by calling us on 0845 257 0348.

RETURNS POLICY

All serial numbers on items are recorded before items are sent out to prevent items being switch and returned.

Please note that as items are consigned to us be a third party, items are treated as one-off items or 'Individuals' and where we are unable to change the item we reserve the right to provide a full refund.

1. Faulty and Damaged Products

Products that are Faulty or Damaged In Transit (Rejected)
In the event that, upon delivery, it is apparent that a delivered Product is obviously faulty or damaged, you must report this to the delivery person at the time of delivery. The driver will telephone us at that point and we will seek to resolve the problem to your satisfaction. Further to this call, if you do not wish to accept the delivery please write “faulty” or “damaged” as the case may be on the delivery docket, together with a brief description of the particulars of the fault or damage. You should ask for and retain a copy of the delivery docket. The delivery person will then return the Product to the distribution centre. We will contact you to arrange reimbursement of your payment.

Products that are Faulty or Damaged in Transit (Accepted)
If you do happen to accept delivery of a Product and subsequently discover that it is faulty or damaged, DO NOT USE THE PRODUCT.
In the event that you take delivery of the Product, but subsequently discover that the Product is faulty or damaged, you must inform us of this as soon as is reasonably possible by calling 0845 257 0348 (please see NOTE below), describing the fault or damage in as much detail as possible. Photographs are often a good way to communicate specific damage. Any use by you of the Product will be construed as your acceptance thereof and will restrict our ability to replace or repair the Product or to refund you. Please retain all original packaging.

NOTE: For courier companies to accept liability for damage caused in transit we must inform them of any damage within 24 hours of delivery. This is why we ask you to inform us about any damage as soon as is reasonably possible following delivery of the Products.

Once we have verified the fault or damage and advised you as such, you will be entitled either to have the Product replaced or repaired or to receive a refund for the Products. You will be offered a replacement or repair in the first instance, but where a replacement or repair is not possible, for example because the Product or parts no longer exist, a refund will be offered instead. All refunds are credited via your original payment method and will be credited within 30 days from our verification of the fault or damage.

Please note that we can only take back displays as faulty for replacement/repair/refund if the number of imperfect pixels exceeds the Manufacturer's guidelines.

3. Warranty

We warrant that we own, or have valid title to, all Product delivered to you and that we are entitled to transfer ownership of the same to you.

We shall endeavour to transfer to you the benefit of any warranty or guarantee given to us by any Manufacturer of Product.

If a specific Product listing does not make express reference to a Manufacturer’s warranty or guarantee then we offer a 28 day ‘return to base’ (RTB) warranty which covers mechanical failures only.

4. Right of Cancellation

A. Your Right to Cancel
Under the Consumer Protection (Distance Selling) Regulations 2000, you have an unconditional right to cancel an order up to fourteen working days after the day of delivery (the “Cancellation Period”, as defined below). You should exercise your right to cancel an order within the Cancellation Period by writing to us via email at customerservices@retailon.com.
Cancellation Period – from the date you place an order until seven working days after the Products have been delivered.

B. Return of Cancelled Product
Where a Product has already been dispatched, customers exercising their right to cancel must ensure that reasonable care is taken of the Product and that the Product can be restored to us (at your expense) in an 'as new' condition, without any damage caused by excessive or unreasonable use. The Product must be returned in its original packaging to prevent any damage in transit. As we will need to return the Products to the Manufacturer, any unreasonable damage you have made to the Product may result in you not receiving a full refund. 9. Force Majeure

We will not be liable to you for any delay or non-performance of our obligations under the Contract to the extent such delay or non-performance arises from an event beyond our reasonable control including act of God, local government or government, war, fire, flood, earthquake or storm, acts of terrorism, explosion, civil commotion or industrial dispute. 

10. Entire Agreement

11. Severability

In the event that any term, condition or provision is determined by a competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

12. Waiver

No failure by us to exercise a right or remedy that we have or which arises in relation to an incident in connection with the Contract shall prevent us from exercising that right or remedy subsequently in respect of that or any other incident.

13. Interpretation

Words in the singular shall include the plural and vice versa.

References to including and includes shall be deemed to mean respectively including without limitation.

A reference to a statute or statutory provision is a reference to it as it is in force for the time being, taking account of any amendment, extension, or re-enactment and includes any subordinate legislation for the time being in force made under it.
