Terms and Conditions

The following terms and conditions of business are exclusively for all deliveries and services in their constitution valid at the moment of purchase.

Prices

All displayed prices contain the statutory value added tax. The prices applied are the ones valid on conclusion of contract. They are provided in the shipping confirmation of your order.

Payment

Payment has to be carried out in advance through bank transfer, credit card or PayPal. In special cases and with regular customers a delivery on credit is also possible. The customer's account will be debited on order acceptance if payment is carried out through credit card.

Warranty

The period for the claiming of warranty rights due to defective merchandise is two years after shipping of merchandise (passing of risk) by the aquirer if the defect was not intentionally misrepresented by silence or a different warranty was provided about the condition of the merchandise. The limitation period for used merchandise is valid within one year after shipping of the goods in favour of the customer if the defect was not intentionally misrepresented by silence to the seller or a different warranty was provided about the condition of merchandise. The warranty is carried out according to legal requirements. With regards to all defects as described above ocurring after shipping within the warranty period for end consumers, you have the legal right of supplementary performance (according to your choice: ractification of defects or replacement) and – on providing the legal requirements – the legal rights of reduction or withdrawal as well as compensation. You have to grant us a total of two attempts of ractification of defects.

In case that the kind of supplementary performance requested by you can only be carried out on unreasonably high expenses, your claim is restricted to the other kind of supplementary performance. For customers who are commercially trading entrepreneurs, a warranty period of one year after shipping of merchandise (passing of risk) is valid as far as the defect would be noticed after immediate examination of the merchandise on receipt, was not intentionally misrepresented by silence and no different warranty was provided about the condition of merchandise. We are not liable for damages and defects caused by inappropriate use, application, and storage, careless or inaccurate care, and maintenance, by overstraining or inappropriate repair through a non-authorised service partner.

Liability for Damage

Liability is excluded for the simple negligent injury of others as cardinal obligations through the seller or its vicarious agents as long as any damages were caused through injury of life, body or health. In these cases, liability is restricted to the damage typically to be expected.

Acceptance / Transfer of Perils

As long as the costumer is consumer, the risk of sudden sinking and deterioration of the merchandise is passed on to him/her on delivery. In this case, the place of delivery is the customer's city of residence. In case the customer refuses to accept the delivery, the risk of sudden sinking and deterioration of the merchandise is passed on to the purchaser in the moment of refusal. If the customer is vendor, the risk of sudden sinking and deterioration of the merchandise is passed on to him/her on passing the merchandise to the company authorised to carry out shipping. In this case, the place of delivery is the vendor's headquaters.

Data Protection

Your data is only collected within the bounds of statutory provisions. You can demand information about the saved data in connection with your person and it will be deleted, corrected and frozen for purposes of advertising or market or opinion research if requested. The deletion of your address requires a notice in writing.

Legal Venue

In case the purchaser is a merchant, a legal person of the public law or seperate estate governed by public law, then the legal venue is at the vendor's business location.

Battery Directive

In connection with the distribution of batteries or storage batteries or the delivery of appliances which contain batteries or storage batteries, we are obliged to point out the following according to the battery directive: batteries must not be put into the houshold rubbish. As an end consumer, you are legally obliged to return used batteries. You can return batteries free of charge after usage in the retail outlet or within your direct environment (e.g. in local collecting point or in other retail outlets). You can also return batteries to us through mail. We even reimburse the expenses for the postage paid for the return of the used battery any case.

Right of Withdrawal

You can retract from your contract declaration without the indication of reasons by written notification (e.g. letter, fax, e-mail) within the period of one month or - in case that you were provided with the merchandise before the expiry of the period - by returning the merchandise. The period commences after receipt of this declaration in written form. In order to observe the withdrawal period it is only necessary to send the returns ort he goods on time. Consequences of Withdrawal

In case of a valid withdrawal the services received by both parties have to be returned and, if applicable, drawn profits (e.g. interests) to be returned. If you cannot return the received service entirely or partially or only in deteriorated condition, you have to provide a compensation of the value. This is not applicable with the surrender of merchandise if the deterioration of the merchandise can only be traced - as it would have been possible in a retail shop - on examination. Additionally, you can prevent your duty of compensation caused by a deterioration due to conventional usage of the merchandise by not using it as your property and refrain from any usage that lowers the value. Parcels that are ready for despatch are to be returned at our risk. You have to pay the expenses for the return if the delivered merchandise corresponds the one ordered. Parcels that are not ready for despatch will be collected at your premises. Duties to reimburse payment have to be fulfiled within 30 days. The period commences for you with the despatch of the merchandise or the notice of withdrawal and for us with the receipt of the same.
