Description (revised) Seller assumes all responsibility for listing this item.

I have for sale a genuine Deed from 1841

This is an acknowledgment of deeds by married women under the fines and recoveries act of 1833

At this time when a woman married, any property she owned automatically passed to her husband.  If he wanted to sell such property, under common law his wife had to be part of the process, or to consent.  This was seen to prevent the husband abusing his position as owner of property gained through marriage.  The document was to show that the wife was of full age and understood the proceedings and agreed to the sale without being forced to

The need for such certificates was ended by the Married Womens Property Act of 1882.  This gave them the same rights as single or widowed women

This particular deed was agreed by Georgina Louisa Tollamache wife of John Tollamache regarding property in the township of Godley in the parishes of Mottram in Longdendale in the County of Chester

Others mentioned in this deed were
George Finch
Anthony Lyster
George Lyle
John Vaughan

The Commissioners were Philip Humberton and Faithful Thomas

The affidavit was taken by George Martin

John Tollemache was born in 1805 and died 1890 at Peckforton Castle
He was the son of Admiral John Richard Delap Tollamache and Lady Elizabeth Stratford
He married Georgina Louisa Best in 1826
Georgina died in 1846
He married his second wife Eliza Georgina Duff in 1850
John was MP for Cheshire South from 1841-1868 and MP for Cheshire West from 1868-1872
He was the largest landowner in Cheshire owning 28.651 acres and was described by William Gladstone as being the greatest Estate Manager of his day
