Terms & Conditions 

1. Our Contract / Definitions

1.1 “The Company" shall mean Powersaver Electrical Supplies Ltd trading as brewtime.com or brewtime.co.uk whose registered office is at Unit 17 Carrs Industrial Estate, Commerce Street, Haslingden, Lancashire BB4 5JT. 
1.2 “The customer" shall mean any person or persons, firm, company or corporation who buys or agrees to buy goods from the company. 
1.3 These Terms and Conditions govern the supply of goods sold by www.brewtime.co.uk or www.brewtime.com of 17 Carrs Industrial Estate, Commerce Street, Haslingden, Lancashire BB4 5JT. Together with the completed order form, these Terms and Conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us, on these terms and conditions. 

2. Conditions Applicable 

2.1 Terms and Conditions shall apply to all contracts for the sale of goods entered into by the Company. All conditions of the Customer or other terms and conditions or warranties whatsoever are excluded from the contract or any variation thereof unless expressly accepted by the Company in writing, and these terms and conditions shall be deemed to be incorporated in any quotation received from the Company and the Customer's own conditions shall not be regarded as a counter offer. 
2.2 The exercise by the Company of any right pursuant to these Terms and Conditions shall be without prejudice to any other right available to it whether hereunder or under general law. 

3. Quotations 

3.1 The Customer acknowledges that no contract was entered into in reliance on any representations other than those incorporated in the Company's quotation and these Conditions, and particularly no catalogue or price list shall form part of the contract documents. 
3.2 A quotation by the Company shall not constitute an offer and there shall be no binding contract until the Company has confirmed acceptance of the order placed by the Customer. 3.3 Unless otherwise specifically stated, all prices quoted by the Company are exclusive of Value Added Tax, which shall be due at the rate in force at the date of the Company's invoice to the Customer. 
3.4 Quotations assume the accuracy of information provided by the Customer and are not valid in the event of any information supplied to the Company being incomplete, inaccurate or misleading. Any modifications to specifications required after the Company has provided a quote may entail an extra charge being raised at a reasonable rate having regard to the nature of the modification. 

4. Delivery and Title 

4.1 We shall deliver the goods in accordance with your order. Remote areas of the UK may have additional delivery charges for certain items, this will be notified via email before despatch.
A valid signature will be required on collection or delivery. Immediately prior to despatch of the goods to you, title in the goods will pass to you. In the unlikely event that you have not received all the goods within 21 days of the date of delivery (or where you have requested a delayed despatch within 21 days of the requested despatch date), you must notify us immediately.

5. Cancellation, Termination and Returns 

5.1 No cancellation, suspension or variation by the Customer of any order accepted by the Company shall be valid unless agreed by the Company in writing, fax or e-mail and such agreement may only be given on terms which compensate the Company for any loss, costs, damages, charges and expenses thereby incurred by the Company, such compensation to be decided by the Company in its absolute discretion. In particular, the Company reserves the right to charge a 20% handling charge for goods which are accepted back into stock for credit, although the Company's claim in this regard may not be limited to this sum. 
5.2 The Company reserves the right to make any changes in the specification of goods which are required to conform with any applicable safety or other statutory requirements or where the goods are supplied to the Customer's specification which do not materially affect their quality or performance. 
5.3 On cancellation due to an incorrect order being placed, you must return the goods to us at your cost within 14 days of the delivery date.
5.4 If the goods are being returned due to incorrect delivery by fault of the company, then a refund of postage costs will be made. The company will nominate the carrier. 
5.5 We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you. 
5.6 If you do not like an item purchased from our online store, for whatever reason, return it to us within 14 days of the delivery date together with the original packaging in 'Saleable Condition' and we will either exchange the item or provide a full refund including return postage costs. 
5.7 If you have requested a non-stock special order item that is not shown on-line at www.brewtime.co.uk or www.brewtime.com that has been ordered in for you, and you would subsequently like to return it, it shall be returned at your cost. We will charge up to 35% returns charge in line with the relevant manufacturers returns charges (excluding VAT@15%). In the case of non-stock items we cannot authorise a refund until it has been authorised by the manufacturer. 
5.8 We make every effort to describe products accurately. While we cannot accept liability for errors or if slight variations in the actual goods occur, we will provide a full refund if you are dissatisfied including return postage costs.
5.9 All returns must have a valid authorisation code prior to return. This must be conducted by e-mail.

5.10 Goods that are received damaged must be reported to us within 24 hours. This is a stipulation of the insurance cover in place with our carrier. We will either exchange them or provide a full refund, this will be provided at our cost. This does not affect your statutory rights as a consumer. 

6. Price & Payment 

6.1 The price payable for the goods you order is as set out on our website at the time you place your order, plus any charges for carriage as set out in the order form. 
6.2 We must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage before your order can be accepted unless we have agreed otherwise in advance in writing. 

7. Availability 

7.1 While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we may, at our discretion, supply or deliver a substituted product or refund you the price paid for such goods as soon as possible and in any case within 30 days. 

8. Warranty 

8.1 Subject as expressly provided in these Terms and Conditions and except where goods are sold or services provided to a person dealing as consumer within the meaning of the Unfair Contract Terms Act 1977 all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permissible by law. 
8.2 All warranty times are governed solely by the manufacturers terms and conditions. 

9. Liability 

9.1 If you have notified us of a problem with the goods, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question in line with the terms and conditions set out under Cancellation, Termination and Returns. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence. 

10. Force Majeure 

10.1 We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes). 

11. General 

11.1 If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law. 

12. VAT 

12.1 All prices at completion of order include VAT at 15% subject to changes in taxation. Goods not subject to VAT are exempt. Vat No. 633868705 

13. Age Requirements for Specific Goods 

13.1 Where the law requires a minimum age limit for the purchase of specific goods, you confirm that you are over the required age limit and the person that will accept delivery is over the required age limit.

Return policy

The Goods may be returned if unwanted within 7 days of purchase(our cooling off period).
Goods must be in the same condition as despatched in, unused and still boxed.
If the goods purchased are faulty, contact us at returns@brewtime.co.uk and we will notify you of the return details and returns numbers required.
Goods may be subject to a handling charge subject to manufacturers terms and conditions if returned faulty and found not to be so.
All returns are sent back at the buyers cost.
