General terms and conditions for contracts with consumers

1. Subject matter of the general terms and conditions

Subject matter of these general terms and conditions is the regulation of terms of contract for all contracts of the firm Andy Kaiser Einzelhandel (SELLER) with buyers (consumers), that are closed by distance trading in the sense of § 312b BGB (German civil code), as well as by direct selling.

2. Closure of contract

The SELLER's offers in the price lists, brochures and on the web site are non-binding. If a desired sort is sold-out we presume to offer an alternative of equal value. A contract comes about after delivery of the goods or with an explicit declaration.

The goods will be solely delivered as pictured in the respective current Internet offers, catalogues, brochures  (hereafter "offers") and in the styles and packing units or minimum quantities stated therein.

Prices are end prices, including all price elements such as VAT. As far as not otherwise explicitly mentioned in our offers, the prices relate to the respective article according to its description, however not to accessories or decorations.

Invoices are payable immediately without any deductions. If the orderer defaults we have the right to demand arrears fees of EUR 10.- as well as default interest of 5 % above the base interest rate, so far as the SELLER does not, in individual cases, demonstrate greater damages or the consumer lesser damages.

If payment-on-delivery dispatches are refused, a blanket compensation charge of 20.- € will be applied, in addition to the costs of the delivery and return delivery (§ 257 II 2 BGB). 

Consumers, in the sense of the distance selling law, have the right to revoke their declaration of intent, given when closing a contract solely by the means of distance selling, between the SELLER and the consumer, with two weeks.

The time limit begins on the day of receiving the goods. The time limit does however not begin before the informational requirements, according to  § 312c  paragraph 2 BGB (German civil code) in connection with  § 1 paragraph 2 und paragraph 3 of the provisions for information requirements according to civil law, and our requirements according to  § 312e paragraph 1 sentence 1 BGB have been fulfilled.

The withdrawal must be made in writing. It can also be made by returning the goods. No reason is necessary. To observe the time limit it is sufficient that the goods are returned within the time limit. In the case of a timely revocation of his declaration of intent, the consumer is not bound to his declaration of intent to close a contract with us. The goods are to be returned to us immediately after making the withdrawal, if this has not already been done.

You must bear the costs of return delivery if the delivered goods correspond to those ordered, and if the price of the goods to be returned does not exceed 40.00 Euro. This also applies if the goods have a higher price and if you have not reciprocated or made a partial payment as contracted  at the time of the withdrawal. Otherwise the return is free of charge for you. You must fulfil commitments regarding payments within 30 days of sending your withdrawal.

You are not committed to returning the goods if they cannot be sent as a packet. In this case we will have the goods collected. In the case of a return of goods valued over 40.- €, please call our service number so that we can arrange the formalities. We will not accept goods returned without postage paid.

Further legal consequences of an effective withdrawal are governed by § 357 BGB and by § 358 BGB if a consumer credit contract is incorporated in the purchase contract.

The right of withdrawal, in the absence of other agreements and unaffected by other legal provisions does not exist for contracts for the delivery of goods made-to-measure or clearly specially designed to suit the customer's needs. This also applies to goods not suitable to be returned on account of their nature, as well as audio/video recordings or software (§ 312 d IV BGB) if this has been unsealed by the customer or newspapers and magazines.

The delivered good remain our property until they have been fully paid for.

The SELLER uses customer data in order to process the order and answer inquiries, and to maintain customer relationships. Third party service providers contracted by the SELLER receive only such data, within the scope of processing the order, as is necessary in order to fulfil their services.

If one or several of the contract's provisions are fully or partly not legally effective or not feasible, or if they later become legally ineffective or unfeasible, this does not affect the validity of the contract's remaining provisions. The provision in question is to be replaced with a valid provision having, as far as legally possible, the same economic meaning for the contractual partners. The same applies if it becomes apparent that the contract has a regulatory gap. Oral or written side agreements to this contract do not exist.  The validity of the General Terms and Conditions of Business of either or both contractual parties is explicitly excluded. Additions or changes to the contract are only effective if they are agreed to in writing and signed by both parties. This requirement can only be removed by a written agreement. German law applies.
