DISTANCE SELLING REGULATIONS

5.1 For Products sold directly to the Private Consumer, Distance Selling Regulations will apply.
5.2 If the Customer is a Private Consumer, they have a right to cancel this contract as long as they do so within the Cooling Off Period.
5.3 If The Customer is not a Private Consumer, they have no right to cancel this contract under the terms of the Distance Selling Regulations.
5.4 If this Contract, or part of this contract concerns Products consisting of,
5.3.1 software that was delivered in sealed packaging, which has been unsealed by the Customer, or,
5.3.2 Products that have been personalised for the Customer, and / or,
5.3.3 equipment that the Company has put together to the Customers specification, then the Customer has no right to cancel this Contract in as much as it applies to those Products. However,
the Customer may cancel this contract in as much as it applies to any other Products.
5.5 If the Customer wishes to exercise any right to cancel this contract, the Customer must notify the Company of the same within the Cooling Off Period in writing.
5.6 Upon receipt of a valid written request cancelling this contract, the Company will send to the Customer, within 14 days, a notice confirming cancellation of the contract and the a valid RMA#.
5.7 If the Product delivered is the Product ordered and the Customer exercise the right to cancel the Contract, upon receipt of the notice confirming cancellation, the Customer must organise delivery of the Product back to the Company, as soon as is reasonably possible, and in any event within 14 days. The Customer is advised to insure themselves against the risks of the Product being damaged in transit.
5.8 If the Product delivered is the Product ordered and the Customer exercise the right to cancel the Contract, then the Customer will be liable to the Company for any costs incurred in delivering the Product back to the Company, including but not limited to the costs of any insurance.
5.9 If the Product delivered is Product the Company have substituted for the Product originally ordered, and the Customer exercise the right to cancel the Contract, the Company will organise collection of the Product for return, at the Company’s cost.
5.10 If the Customer exercise any right to cancel this contract, and
5.10.1 the Product is in any way damaged other than by the Company or our agents, including but not limited to damage incurred during transit of the Product or,
5.10.2 the Product has not been retained by the Customer with reasonable care, whether or not the Customer is at fault, or,
5.10.3 the Customer has not retained possession of the Product, whether or not the Customer is at fault, or,
5.10.4 the Customer has failed to return the Product to the Company, within 14 days of receipt by the Customer of our notice confirming the Customer’s cancellation, then the Customer will be liable to the Company for an amount to cover the losses flowing from the above; and further, or in the alternative, the breach of the Customer’s statutory duty under regulation 17 of the Distance Selling Regulations (duty to retain possession of Product, take reasonable care of them and restore them to the supplier).
5.11 If the Customer exercise any right to cancel the Contract, upon receipt of the Product, the Company will reimburse the Customer all monies paid in respect of those Products, less an amount to cover any liabilities the Customer have to the Company under clause 5.8 and 5.10 of this contract.
5.12 If the Customer is not totally satisfied with the purchase or the Customer has changed their mind about the purchase then in line with the Distance Selling Regulations, the Customer can return the item provided the Company is advised in writing within 7 days of receipt. Once the Customer has informed the Company of the decision to return goods under the Distance Selling Regulations, the Customer has 14 days to return the item(s) at the Customers own expense. The Customer is responsible for the safe return of the Product. The Product must not be opened nor used and must be 'as new' when returned to the Company. All items must be complete with original packaging, manuals, disks, cables etc as originally supplied. Manufacturer packaging must not be defaced in any manner. Once the Product is received at 3PS UK Limited, a full refund for the cost of the Product will be issued to the original payment method. Please note business Customers are exempt from returning items within 14 days under the Distance Selling Regulations.
5.13 Please note that item(s) sent back to the Company without a valid RMA number will be rejected. The Customer will be liable for all postage costs for unauthorised items. Authorised RMA numbers will be valid for 14 days only. |
