Such an ineffective regulation or gap will be substituted by a similar regulation aiming at an economic purpose of the agreement, which would have been agreed upon by the parties, if they had known about the ineffectiveness of that regulation.

Instructions of Cancellation

I. The Right of Withdrawal

1. If the customer is the consumer, he is entitled to cancel his contractual statement in written form (e.g. letter, telefax, email) within a month without giving reasons or simply return the goods.

2. The term begins the day after the customer received the goods and after the customer has also received a separate letter including the instructions of cancellation in written form (e.g. letter, telefax, email).

3. To meet the deadline, timely mailing of the goods or the letter containing the instructuions of cancellation shall suffice.

4. The right of withdrawal, however, does not apply to exceptional cases as provided by law, in articular

• concerning contracts on the delivery of goods that have been produced according the customer’s wishes or
• concerning goods that have explicitly been produced to the customer’s personal needs or
• concerning goods that due their composition cannot be returned or
• concerning the delivery of audio- or videomaterial or any kind of software, if the data carriers delivered have been unsealed by the customer

II. Consequences of cancellation

1. In case of an effective cancellation the goods received as well as profits made from them (e.g. interest) have to be returned If the customer is unable to return the goods received as a whole or partially or in an impaired state, he will have to grant
compensation. This does not apply with goods, if
• their impairment (or their destruction) is entirely due to their testing – as would have been possible in a shop – or
• the impairment of the goods is caused by normal use

2. Goods that can be delivered in a parcel have to be returned. In this case the seller bears
the risk of delivery. The customer has to bear the costs of shipping, if the goods delivered corresponds the one ordered and if the price of the item returned does not exceed the amonut of € 40 or if the customer - in case of a higher price of the item – at the time of cancellation has not provided a return service or a contractual payment of instalment. In any other case
reshipment is free for the customer. The costs of delivery of the goods, however, are paid by the seller in any case. Goods that cannot be sent in a parcel are collected at the customer’s.
